Madras High Court Quashes Disqualification of B.T Asst. Holding Dual Degrees: Petitioner’s Appointment and Benefits Upheld

Mrs. S. Kirubavathi vs. Government of Tamil Nadu & Others

The petitioner was appointed to the post of a B.T.Asst (English) after completing a dual degree program in B.A.English. However, the said appointment came under challenge as she was subsequently disqualified in 2016 by virtue of the ratio laid down in the case of R.Thirunavukkarasu v. The State of Tamil nadu rendered on 14.08.2012 which held that teachers holding double/dual degrees are not qualified to the post B.T Asst. By squarely holding that the said judgement only has a prospective effect and not a retrospective effect, the Hon’ble Madras High Court quashed the order of rejection and confirmed the date of appointment of the petitioner which was prior to the Thirunavukkarasu’s precedent with all accruing monetary benefits from the year 2012.
